End User License Agreement (EULA)
ExamLab for SCJP 6.0 – Freeware License Agreement

IMPORTANT READ CAREFULLY: This End-User License Agreement ("EULA") is a legal agreement between you (either an individual person or a single legal entity, who will be referred to in this EULA as "You") and the Licensor for the ExamLab for SCJP 6.0 that displays this EULA, including any associated media, printed materials and electronic documentation (the "Software"). The Software also includes any software updates, add-on components, web services and/or supplements that the Licensor may provide to You or make available to You after the date You obtain Your initial copy of the Software to the extent that such items are not accompanied by a separate license agreement or terms of use. By installing, copying, downloading, accessing or otherwise using the Software, You agree to be bound by the terms of this EULA. If You do not agree to the terms of this EULA, do not install, access or use the Software. For purposes of this EULA, the term "Licensor" refers to ExamLab for SCJP 6.0, except in the event that You acquired the Software as a component of the ExamLab for SCJP 6.0 software product originally licensed from the manufacturer of your computer system or computer system component, then "Licensor" or refers to such hardware manufacturer. By installing, copying, downloading, accessing or otherwise using the Software, You agree to be bound by the terms of this EULA.


GRANT OF SINGLE-USER LICENSE. YOU ARE THE ONLY PERSON ENTITLED TO USE THIS SOFTWARE. This is a license agreement between you (an individual) and DevSoft Corporation whereby DevSoft grants you the non-exclusive and non-transferable license and right to use this software product, updates (if any), and accompanying documentation (collectively the "Software"). ONLY YOU (AND NO ONE ELSE) IS ENTITLED TO INSTALL, OR USE THE SOFTWARE. DevSoft continues to own the Software, and the Software including it's questions, answers, and explanations, is protected by copyright and other international intellectual property laws. All rights, title, interest, and all copyrights in and to the Software and any copy made by you remain with DevSoft. Unauthorized copying of the Software, or failure to comply with this Agreement will result in automatic termination of this license, and will entitle DevSoft to pursue other legal remedies. 


IMPORTANT, under the terms of this Agreement:

YOU MAY:

(a) install and use the Software on only one computer or workstation, and
(b) make one (1) copy of the Software for backup purposes only on another computer or workstation.

 

Restrictions:

(a) You may not sell, license or distribute copies of the Software on a stand-alone basis or as part of any collection, product or service where the primary value of the product or service are the Software. 
(b) All the Exam Questions, answers and explanations in this software are reserved by DevSoft corporation, Sri Lanka. You may not copy, recreate, extract, or distribute these questions, for any reason.
(c) You may not use or distribute any of the Software that include representations of identifiable individuals, governments, logos, initials, emblems, trademarks, or entities for any commercial purposes or to express or imply any endorsement or association with any product, service, entity, or activity. 
(d) You must indemnify, hold harmless, and defend ExamLab for SCJP 6.0 from and against any claims or lawsuits, including attorneys' fees, that arise from or result from the use or distribution of Software as modified by You. 

 

TRADEMARKS: Sun, Sun Microsystems, the Sun logo, and java are trademarks or registered trademarks of Sun Microsystems, Inc. Microsoft, JET, and JET Driver are trademarks or registered trademarks of Microsoft corp. All other brands and products names are trademarks or registered trademarks of their respective owners.

TERM: The term of the license granted above shall commence upon your installation of the Software. Such license will expire SIX (6) MONTHS after commencement of the license term.

WARRANTY, LIMITATION OF REMEDIES AND LIABILITY: If applicable, DevSoft warrants the media on which the Software is recorded to be free from defects in materials and free from faulty workmanship for a period of thirty (30) days after the date you receive the Software. If, during this 30-day period, the Software media is found to be defective or faulty in workmanship, the media may be replaced without charge. Above warranty may not apply, if the software was downloaded from internet. YOUR SOLE REMEDY UNDER THIS AGREEMENT SHALL BE THE REPLACEMENT OF DEFECTIVE MEDIA AS SET FORTH ABOVE. EXCEPT AS EXPRESSLY PROVIDED FOR MEDIA ABOVE, DevSoft MAKES NO OTHER OR FURTHER WARRANTIES REGARDING THE SOFTWARE, EITHER EXPRESS OR IMPLIED, INCLUDING THE QUALITY OF THE SOFTWARE, ITS PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. THE SOFTWARE IS LICENSED TO YOU ON AN "AS-IS" BASIS. THE ENTIRE RISK AS TO THE SOFTWARE'S QUALITY AND PERFORMANCE REMAINS SOLELY WITH YOU. DevSoft's EXCLUSIVE AND MAXIMUM LIABILITY FOR ANY CLAIM BY YOU OR ANYONE CLAIMING THROUGH OR ON BEHALF OF YOU ARISING OUT OF YOUR ORDER, USE, OR INSTALLATION OF THE SOFTWARE SHALL NOT UNDER ANY CIRCUMSTANCE EXCEED THE ACTUAL AMOUNT PAID BY YOU TO DevSoft FOR THE SOFTWARE, AND IN NO EVENT SHALL DevSoft BE LIABLE TO YOU OR ANY PERSON OR ENTITY CLAIMING THROUGH YOU FOR ANY INDIRECT, INCIDENTAL, COLLATERAL, EXEMPLARY, CONSEQUENTIAL, OR SPECIAL DAMAGES OR LOSSES ARISING OUT OF YOUR ORDER, USE, OR INSTALLATION OF THE SOFTWARE OR MEDIA DELIVERED TO YOU OR OUT OF THE WARRANTY, INCLUDING WITHOUT LIMITATION, LOSS OF USE, PROFITS, GOODWILL, OR SAVINGS, OR LOSS OF DATA, FILES, OR PROGRAMS STORED BY THE USER. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

PLEASE READ CAREFULLY. THE FOLLOWING LIMITS SOME OF YOUR RIGHTS, INCLUDING THE RIGHT TO BRING A LAWSUIT IN COURT. By accepting this Agreement, you and DevSoft agree that all claims or disputes will be submitted to binding arbitration if demanded by either party. The arbitration will be handled by the courts of Colombo, SRI LANKA; or USA and governed by its rules. This Agreement requiring arbitration (if demanded) is still fully binding even if a class action is filed in which you would be a class representative or member. You and DevSoft agree that the arbitration of any dispute or claim between us will be conducted apart from all other claims or disputes of other parties and that there will be no class or consolidated arbitration of any claims or disputes covered by this Agreement. You and DevSoft Corporation also agree that this Agreement does not affect the applicability of any statute of limitations.

REPORTING BUGS: At this time there are no known bugs in the product. However, if you find any bugs, please report it to cs@examlab.tk.

ENTIRE AGREEMENT. This EULA (including any addendum or amendment to this EULA which is included with the Software) is the entire agreement between you and DevSoft Corporation relating to the Software and the support services (if any) and they supersede all prior or contemporaneous oral or written communications, proposals and representations with respect to the Software or any other subject matter covered by this EULA. To the extent the terms of any DevSoft policies or programs for support services conflict with the terms of this EULA, the terms of this EULA shall control.
